By using this website, submitting a form, or agreeing to receive communications from us, you accept these Terms. Please read them together with our Privacy Policy.
By accessing this website, requesting a quote, submitting a contact form, or opting in to receive text messages or email from us, you agree to these Terms. If you do not agree, please do not use this website or submit your information to us.
Best In The West Construction LLC is a family-owned metal building, roofing, fencing, and carport contractor serving West Texas. Our address is 718 US HWY 180 Unit E, Seminole, TX 79360. You can reach us at (432) 209-1680 or info@bestinthewesttx.com.
We build and install metal buildings and barndominiums, metal roofing, fencing, and carports, and we take on commercial work in these categories. The information on this website describes our services generally. It is not an offer, and it does not create a contract between us.
Requesting a quote through this website does not create a contract or obligate either of us. Quotes are prepared after we review your project, and in most cases after an on-site visit. Any figures we discuss before that visit are preliminary and subject to change.
A written proposal becomes binding only when it is signed by you and accepted by us. Pricing in a proposal is valid for the period stated in that proposal. Material availability, supplier pricing, and conditions discovered once work begins may require a written change order before we proceed.
Any financing we make available is provided by third-party lenders, not by Best In The West Construction LLC, and is subject to the lender’s own application, terms, and credit approval.
When you request a quote or service, you authorize us to contact you by phone or email to schedule a visit, and you agree to provide safe and reasonable access to the areas where work is to be measured or performed. Scheduling is subject to weather, material lead times, and crew availability. We will keep you informed of changes that affect your project.
Program description. Best In The West Construction operates two separate text message programs. You may opt in to either, both, or neither.
Customer care and transactional messages. If you check the transactional text message box on one of our forms (our quote request, contact, or paid-advertising quote form), you agree to receive text messages from Best In The West Construction at the mobile number you provided relating to your request or project, including appointment confirmations and reminders, quote and scheduling updates, crew arrival notices, and replies to questions you send us.
Marketing and promotional messages. If you check the marketing text message box, you agree to receive recurring automated marketing text messages from Best In The West Construction at the mobile number you provided, including seasonal promotions, service announcements, and special offers.
Consent is not a condition of purchase. You are not required to agree to receive any text messages in order to request a quote, buy any product, or receive any service from us. On our quote request, contact, and paid-advertising quote forms the text message boxes are optional and unchecked by default. The separate “Get text updates” sign-up in our website footer exists only to join the marketing text list, so agreeing to receive those messages is required there — but that sign-up is never a step in requesting a quote or service. In every case you must opt in affirmatively before we will text you.
Message frequency. Message frequency varies.
Message and data rates. Message and data rates may apply, depending on your mobile carrier and plan. Best In The West Construction is not responsible for charges assessed by your carrier.
How to opt out. You may opt out at any time. Reply STOP to any message from us and we will stop sending you text messages. After you send STOP we will send one confirmation message, and you will not receive further text messages from us unless you opt in again.

Carriers. Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and may be affected by your device, your carrier, or coverage in your area.
Supported devices. Receiving our messages requires a mobile device capable of receiving SMS text messages on a participating carrier.
Privacy and sharing. We do not sell, rent, or share your mobile phone number or your SMS consent information with third parties or affiliates for their own marketing purposes. Mobile information will not be shared with third parties for marketing or promotional purposes. Information may be shared only with the service providers that operate our messaging, scheduling, and customer record systems on our behalf, and only as needed to deliver these messages to you. Changing your number. If you change or give up the mobile number you gave us, please tell us at (432) 209-1680 so that we do not text a number that is no longer yours.
We collect text message consent through unchecked checkboxes on our website forms. On our lead forms these boxes are optional; the one exception is the standalone marketing sign-up described below. The following consent language appears on our quote request form, our contact form, and our paid-advertising quote form:

On these forms the two text message consent boxes are separate from one another, neither is pre-checked, and neither is required in order to submit the form. Our website footer also carries a standalone “Get text updates” sign-up for the marketing list only, using this language:

The footer sign-up also carries a second required checkbox, “I accept the Terms of Service and Privacy Policy.” Both boxes on that sign-up must be checked to join the text list.
We record the date, time, and origin of the consents we receive.
If you provide an email address when you submit a form, we send you a confirmation email and may follow up by email about your request and any resulting project. That is transactional email about work you asked us about. If we later send you marketing email, every such message will carry an unsubscribe link you can use at any time.
You agree to use this website only for lawful purposes and not to interfere with its operation, attempt to gain unauthorized access to it, or submit false information or another person’s contact details.
The content on this website, including text, photographs, graphics, and our name and logo, is owned by Best In The West Construction LLC or used with permission, and is protected by applicable law. You may not reproduce, distribute, or use it commercially without our written permission. Manufacturer names, product names, and logos belong to their respective owners.

To the fullest extent permitted by law, Best In The West Construction LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of your use of this website or our communications, even if we have been advised of the possibility of such damages. These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute arising out of these Terms or your use of this website will be brought in the state or federal courts located in Gaines County, Texas, and you consent to the jurisdiction of those courts.
We may update these Terms from time to time. Any changes will be posted on this page with an updated revision date. Your continued use of the website after a change takes effect means you accept the revised Terms.
